WHAT IS A BAIL BOND?

A bail bond is a monetary guarantee to the court that a defendant will appear each and every time the defendant is ordered to do so while the case is pending.

The bail agent, a state licensed bail bondsman who is backed by an insurance company, guarantees to the court payment of the full amount of the bond if the defendant fails to appear for their scheduled court appearances.

WHAT IS THE COST OF A BAIL BOND?

In most states, including Arizona, the cost of a bail bond is 10% of the bail. Each state sets their own rates and those rates are non-negotiable. For example, if a bail is set at $25,000, then the premium charged is $2500, no more and no less by law.

CAN I RECOVER THE 10% FEE I PAY TO MY BAIL BONDSMAN?

Bail bond premiums are non-refundable, as they are used for the bail agent's expenses. That amount of money is used to pay for the services of the bail bondsman.

WHAT IS A BAIL BOND INDEMNITOR?

A bail bond indemnitor is the co-signer for the bail bond. The indemnitor is the person who typically provides the collateral and premium for the defendant.

WHERE CAN A BAIL BOND BE POSTED?

A bail bond can be posted at most courts and jails. Most jails accept bail bonds 24 hours a day, 7 days a week, 365 of the year.

WHAT IF I AM CALLING FROM OUT OF THE AREA OR FROM ANOTHER STATE?

If you are out of the area or live in another state and you have a friend or family member in custody, it is still possible to obtain a bail bond. The bail bond contract can be faxed to you and payment can be received by credit card.

WHAT IS COLLATERAL?

Collateral is something of value that is used to secure a debt or ensure payment. Sometimes a bail bond company will receive collateral in order to ensure that the defendant appears in court. Most bail bond collateral is in the form of car titles, real estate, or cash.

A bail bond company must return your collateral at the resolution of the case.

IF I USE COLLATERAL FOR A BAIL BOND, WHEN DO I GET IT BACK?

When the defendant's case completed or the Judge exonarates the defendants bond and all financial obligations are satisfied, collateral is returned to the individual who pledged it.
